Terms of Use — Hearing Aid App AI – ngHero

These Terms of Use (“Terms”) govern your use of the mobile application Hearing Aid App AI – ngHero (“the App”), published by NgheRo.Vn (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices that you own or control, for your personal, non-commercial use, in accordance with the applicable App Store’s usage rules.

This license does not permit you to:

  • Copy, modify, or create derivative works of the App
  • Reverse-engineer, decompile, or disassemble the App, except where permitted by law
  • Rent, lease, sell, redistribute, or sublicense the App
  • Use the App for any unlawful purpose

2. Not a Medical Device — Assumption of Risk

The App provides sound amplification, noise reduction, and a self-administered hearing test for reference and convenience purposes only. Please read this section carefully before using the App.

  • The App is not a medical device, is not FDA-cleared, CE-marked, or equivalently certified as a hearing aid, and is not intended to diagnose, treat, cure, mitigate, or prevent any hearing condition, hearing loss, or disease.
  • The in-app hearing test is a self-administered, informal screening tool. It does not replace a professional audiological evaluation, and its results must not be used as the sole basis for any decision about your hearing health. If you have concerns about your hearing, or suspect hearing loss, consult a licensed audiologist or physician before relying on the App.
  • The App is not a substitute for a prescription hearing aid or other certified assistive listening device. If you have been diagnosed with hearing loss or another hearing condition, use the App only as directed by your healthcare provider, and do not delay or forgo professional care because you are using the App.
  • Sound amplification carries a risk of hearing damage. Amplification and volume levels are user-adjustable, and you are solely responsible for the levels you choose. Exposure to loud sound — including sound amplified by the App, whether through headphones, a Bluetooth speaker, or any other output device — can cause temporary or permanent hearing damage, tinnitus, or other injury, particularly with prolonged use or at high volume. Lower the volume immediately if you experience discomfort, ringing in your ears, or pain.
  • Do not rely on the App in situations where undetected or delayed sound (for example, alarms, traffic, or emergency signals) could put you or others at risk. You are responsible for your own safety and awareness of your surroundings while using the App.
  • The App is not intended for use by young children without adult supervision, given the risk of accidental volume increases and hearing damage.
  • By using the hearing assistance, amplification, or hearing test features, you acknowledge these risks and assume full responsibility for your use of the App, including your choice of volume and duration of use.

3. Subscriptions and In-App Purchases

Certain features of the App are offered through auto-renewing subscriptions or one-time in-app purchases, processed by the Apple App Store or Google Play, as applicable.

  • Price and billing cycle are displayed on the purchase screen before you confirm a subscription.
  • Auto-renewal: Subscriptions automatically renew for the same duration and price unless cancelled at least 24 hours before the end of the current period.
  • Payment: Payment is charged to your Apple ID or Google Play account at confirmation of purchase and at each renewal.
  • Managing or cancelling: You can manage or cancel your subscription at any time in your Apple ID account settings (iOS) or Google Play subscriptions (Android). Cancelling stops future renewals but does not refund the current billing period.
  • Free trial: If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
  • Refunds: Refund requests are handled by Apple or Google according to their respective policies, not directly by us.
  • On Android only, the App additionally supports an optional partner/invite-code activation method for eligible organizational partners, separate from and unrelated to in-app purchases. This method is not available on iOS.

4. User Conduct

You agree not to:

  • Use the App to violate any applicable law or regulation
  • Attempt to gain unauthorized access to our servers or backend systems
  • Interfere with or disrupt the integrity or performance of the App
  • Use automated means to access or use the App without our permission

5. Intellectual Property

The App, including its design, graphics, and underlying software, is owned by NgheRo.Vn and protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 1, no rights are transferred to you.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what information we collect and how we use it.

7. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law:

  • NgheRo.Vn shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data or loss of profits, arising from your use of or inability to use the App.
  • NgheRo.Vn shall not be liable for any hearing damage, hearing loss, tinnitus, pain, or other injury resulting from your choice of volume, amplification level, or duration of use, from your reliance on the in-app hearing test in place of professional evaluation, or from your use of the App instead of, or in delay of, appropriate medical or audiological care.
  • NgheRo.Vn shall not be liable for any harm arising from your failure to notice ambient sounds (such as traffic or alarms) while using the App.
  • In no event shall NgheRo.Vn’s total liability to you for all claims arising from or relating to the App exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.
  • Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Nothing in this Section limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our gross negligence or willful misconduct.

9. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App and delete it from your device at any time.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence apply.

12. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply and take precedence over any conflicting terms in this document:

  • This license agreement is concluded between you and NgheRo.Vn only, and not with Apple Inc. (“Apple”). NgheRo.Vn, not Apple, is solely responsible for the App and its content.
  • The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the App Store’s Usage Rules.
  • Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, any claim that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  • Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights.
  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and Apple’s subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance, Apple has the right to enforce this agreement against you as a third-party beneficiary.
